6 parts of this document need review before it is final
Everything else here describes how BuyLow works today, checked against the running product. The parts marked Needs review cover decisions that have not been made yet. The operating entity, governing law, liability limits, tax handling, a contact address. They are listed so you can see them, not filled in with plausible-sounding text that nobody has agreed to.
1.About this agreement
BuyLow is an online marketplace. Sellers open a storefront on BuyLow, list the products they want to sell, set their own prices and shipping rate, and fulfil the orders they receive. Buyers browse those storefronts, order from one or more of them, and pay through BuyLow. One account can be used to buy and to sell.
This agreement is between you and the business that operates BuyLow (referred to here as we, us or BuyLow). It applies to your use of buylow.live and of the seller tools at the same site. It does not create a contract between you and any individual seller — that relationship is separate, and section 12 explains what happens to orders already placed when an account is closed.
Read this alongside the other policies
This agreement covers conduct and responsibilities. How we handle your personal information is in the Privacy Policy, how money moves through checkout is in the Payments Terms of Use, and what we store in your browser is in the Cookie Policy.
2.Accepting these terms
By creating an account, listing a product, placing an order or otherwise using BuyLow, you agree to this agreement. If you do not agree with it, do not create an account or use the service.
If you accept these terms on behalf of a business, you confirm that you are authorised to bind that business, and that “you” in this agreement covers both you and that business.
We may ask you to accept a revised version of these terms before you continue to use a feature that has changed materially. Continuing to use the service after a revision is published means you accept the revised version.
Needs review
- The registered name, company number and registered address of the entity that operates BuyLow.
- The address and email address that formal notice of a claim must be sent to.
- A minimum age requirement. The product does not currently set or verify an age at registration, checkout or store creation, and no age is inferred from the optional date of birth field on your profile.
- Whether additional terms are required for buyers or sellers in particular jurisdictions.
3.Your account
Registration needs an email address, a password and, optionally, your name. Passwords must be at least 8 characters and contain both letters and numbers. Passwords are stored only as a bcrypt hash — we cannot read yours.
We email you a verification link, valid for 24 hours, and a six-digit code, valid for 15 minutes. You can browse, build a cart and chat without verifying, but you must verify your email address before you check out or open a store.
If you have signed in before, you stay signed in for up to 30 days. That is a session cookie held in your browser, and signing out ends it immediately. Changing your password signs you out on every device and sends a notice to your email address.
One email address is one account, and one account may hold one storefront. You can buy and sell on the same account at the same time; you cannot open a second storefront from the same account.
- Keep your password to yourself, and use a password you do not use anywhere else.
- Tell us promptly if you think someone else has used your account. Email us and we will revoke your active sessions.
- Keep the email address on your account working, because order, shipping and security notices go there.
- Give accurate information. Accounts with false or misleading details can be suspended.
4.Buying on BuyLow
Product listings are written by independent sellers. We do not check every listing, so the name, description, photos, price and availability of a product are the seller's statements, not ours. If a listing is wrong or the product is not what it claims to be, that is a matter between you and the seller — tell the seller first, and use the order page and chat to keep the record.
When you check out, a single basket is split into one order per store, and one payment covers all of them. Each seller sees only their own part of the basket, and only the shipping details needed to deliver it.
- Prices are in US dollars. BuyLow does not convert currency.
- Shipping is charged by the seller, at a rate per kilogram that each seller sets for their own store. We do not add a platform shipping fee on top.
- A coupon you enter applies only to the products of the store that issued it.
- Stock is only reduced once payment succeeds, not when you add something to your cart.
- You can leave a chat open with a store from its page, and you can start a request for quotation when you need a price from several sellers.
5.Orders, shipping and tracking
Every order moves through the same stages: awaiting payment, paid, processing, shipped, delivered. An order can also end as cancelled or payment failed. Sellers move an order forward one stage at a time; they cannot skip a stage or move it backwards.
To mark an order as shipped, a seller must enter a carrier and a tracking number. We generate a tracking link from those two fields so you can follow the parcel. You can see the current stage, the full status history and the tracking details on the order page at any time.
You can cancel an order yourself while it is still paid or processing — that is, before the seller marks it as shipped. Cancelling triggers a refund of the full amount to your original payment method. After an order is shipped, we cannot cancel it for you; contact the seller, and see section 8 for what happens next.
You are responsible for the delivery address
Enter the address you want the parcel delivered to. The address you give at checkout is passed to the seller so they can ship, and a mistake there can delay or misdirect a delivery. We do not check addresses against a postal database.
6.Selling on BuyLow
Opening a store needs a verified email address and a store name and description. After that you can publish products with photos, a description, a price, stock, weight and dimensions, variants such as size or weight options, and lower unit prices for larger quantities.
The details you enter have real consequences. Shipping is calculated from the weight and dimensions on the listing and your per-kilogram rate, so an inaccurate weight means a wrong shipping charge. A wrong stock figure means orders you cannot fulfil.
- Describe and photograph your own products. Do not use another seller's photos, brand names or descriptions.
- Set a shipping rate per kilogram that reflects your costs, and publish opening hours and a return policy so buyers know what to expect.
- Accept and fulfil the orders you receive, and move them through the stages in section 5. Enter a real carrier and tracking number when you ship.
- Reply to buyer messages and to any request for quotation you choose to bid on.
- Keep your stock counts accurate. When stock crosses your low-stock threshold we tell you, and it stays marked until you restock.
- Pay any taxes, duties or registration costs your business owes. BuyLow does not calculate or collect them for you.
The free plan allows up to 10 active products. Higher limits are available on paid plans; see section 9.
7.Reviews, listings and other content
You can review a product or a store only if you have a delivered order for it — reviews are tied to a real purchase. You can write one review per product and one per store, with a rating from 1 to 5 stars, a comment and up to a set of photos. You can delete your own review at any time.
A seller can reply publicly to a review, and can edit or remove that reply. A store can require reviews to be approved before they appear, and can turn off store reviews entirely; where that setting is on, nothing you submit is published without the store's approval.
You keep ownership of everything you post. By posting it on BuyLow you give us a licence to host it and show it to the people who use the marketplace, for as long as it stays up, and to display it in the context of the order or listing it belongs to. You confirm that you have the right to post what you submit.
We may remove content that breaks the rules in section 10, that infringes someone else's rights, or that we are required to remove by law.
8.Messages and requests for quotation
Buyers and sellers can exchange messages. Messages are stored, and rude language is masked with asterisks before it is stored, so it cannot reappear in the history. Messages are limited to 4,000 characters.
A request for quotation lets you describe what you need and receive sealed bids from sellers. Other sellers cannot see your bids, and you cannot see theirs, until the deadline passes — including after you have submitted your own. Each seller may hold one bid per request, and submitting again replaces it.
Do not use messages to send anything unrelated to an order, and do not ask a seller for contact details outside BuyLow. Messages are visible to us for safety and support.
9.Fees, plans and payments
BuyLow does not charge a fee to list a product. Any platform fee on an order is shown to the seller on that order and in their payouts. Payment for your orders goes through the payment provider you choose at checkout, on the terms set out in the Payments Terms of Use.
Seller plans limit how many products you can keep active. The free plan allows 10. Paid plans exist in the system, but their prices have not been published, so no subscription can be charged today. When a price is published it will appear in the seller area before you are asked to pay, and a subscription can be cancelled at the end of the period you have already paid for.
The shipping charge in an order is calculated from the per-kilogram rate set by the store you ordered from. We do not add a separate shipping surcharge to it.
Needs review
- Platform fee wording to confirm with the owner: whether a platform fee or commission applies to sellers, at what rate, and what it is calculated on. The rate is a setting the owner can change at any time and is copied onto each order when it is paid, so this page deliberately states no number and does not say that no fee exists.
- How seller payouts are described, including the minimum payout and when earnings become available.
10.Prohibited activities
When you use BuyLow you may not:
- Sell or offer anything unlawful in the jurisdiction the buyer is in, or anything you do not have the right to sell. No restricted-item list has been published yet — the one that applies to you is not decided.
- List a product you have not got, or knowingly misstate its price, stock, weight, condition or origin.
- Use another person's name, images, brand or trademark in a way that suggests the product or the store is theirs.
- Copy, scrape, harvest or bulk-download listings, prices, reviews or seller data by automated means, or test, probe or overload the service.
- Interfere with the service or try to get into accounts, stores or orders that are not yours, including by guessing passwords or tokens.
- Create accounts to get around a plan limit, a rate limit, or a suspension.
- Post content that is unlawful, that infringes someone else's rights, or that harasses or defames another person.
- Use BuyLow to send unsolicited bulk messages, or to ask anyone to move a transaction off the platform so it can be avoided.
Some rules are enforced in the product rather than by us alone. Store names and descriptions are rejected if they contain abusive language, chat messages are masked, and products can be hidden and accounts or stores suspended by our administrators. A suspended user cannot sign in; a suspended store loses access to the seller tools and its listings leave the catalog.
11.Intellectual property
You keep ownership of your product photos, descriptions, store name and any other content you upload. You grant us the licence described in section 7 to host and display it.
The BuyLow name, logo, site design, code and the arrangement of the marketplace belong to us and our licensors. Please do not use them in a way that suggests an official relationship, and do not copy substantial parts of the site into another product.
If you believe something on BuyLow infringes your rights, tell us and we will look at it. We will remove content that we confirm infringes.
12.Suspension and termination
You can stop using BuyLow at any time. Closing your account ends your access to the buyer tools, the seller tools and your storefront. You can delete your account yourself, under Account → Delete Account in the app or at buylow.live/account/delete. That erases your personal details and signs you out everywhere; the Privacy Policy lists what is kept. If you have an order or payout in progress you will be asked to finish it first.
We may suspend or close an account or a store if you break this agreement, if a buyer or seller complains and we cannot resolve it, if a listing is unlawful, or if we are required to by law. A suspended user cannot sign in, and we revoke their active sessions. A suspended store loses access to the seller tools immediately, and its products stop appearing in the catalog.
Suspending an account does not undo what happened while it was open. Orders already paid for must still be shipped, delivered, or cancelled with a refund, reviews and messages already posted stay visible, and money already paid out to you is not clawed back by a suspension.
13.Disclaimers
BuyLow is provided on an “as is” and “as available” basis. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components, or that any particular listing, price or seller will be available.
Listings, product quality, delivery by a carrier, and anything a seller says are provided by that seller. To the extent we can, we pass those statements through unchanged, and we do not endorse them.
We are not responsible for a seller's own legal compliance, for the accuracy of a weight or dimension that produces a shipping charge, or for a delivery made outside the seller's own carrier.
14.Limitation of liability
This section is deliberately empty until it is written with legal advice. A liability clause that is guessed at is worse than no clause, because it may not be enforceable and may not protect the business.
Needs review
- The cap on total liability, and whether it is per order, per account, or unlimited for certain losses.
- Which categories of loss are excluded, for example indirect or consequential loss, lost profit, or lost data.
- The carve-outs, for example death or personal injury caused by negligence, fraud, or anything that cannot lawfully be limited.
- Whether liability is capped for sellers as well as buyers, and whether a separate higher cap applies to a seller's product liability.
- How liability is apportioned between BuyLow and the seller for a faulty product or a failed delivery.
15.Indemnity
This section is deliberately empty until it is written with legal advice.
Needs review
- Whether sellers indemnify BuyLow against claims arising from what they list, from a product they ship, or from an intellectual property they infringe.
- Whether buyers indemnify BuyLow for anything they post.
- The procedure a claimant must follow, including notice requirements and control of the defence.
16.Governing law and disputes
This section is deliberately empty until it is written with legal advice. We would rather tell you plainly that no governing-law or dispute clause has been agreed than publish one that has not been reviewed.
Needs review
- Which country's or state's law governs, and that this is the law the parties submit to even where you live elsewhere.
- Whether disputes go to courts, to arbitration, or to a staged process that starts with a direct complaint to us.
- If arbitration: the rules, the seat, the language, the number of arbitrators, and how costs are shared.
- Whether a class-action waiver applies, and whether a consumer in a mandatory consumer forum keeps the right to use it.
- Any obligation to attempt resolution informally, and the time limit for starting proceedings.
17.Changes to these terms
We may change this agreement. The date at the top of this page always shows the version you are reading, and a material change is announced by email to the address on your account before it takes effect.
If you do not accept a change, you can stop using the service and close your account. If you keep using it after the change takes effect, you accept the new version. Orders placed before a change are still governed by the version that was in force when they were placed.
18.How to contact us
Questions about this agreement, a problem with an order, or a request to close an account can all go to the same address once it is published.
Needs review
- The postal address for formal notices and claims.
- The email address for support, legal notices, and data-protection requests. The transactional sender address is not monitored as a contact channel.
- Whether a representative must be named for the EU, the UK, Switzerland, California or other jurisdictions.
